CaratScanner is an online gemstone image analysis service that allows users to upload or capture images of diamonds and diamond-like stones and receive an image-based report containing estimated characteristics such as stone type, shape, color, carat weight, cut-related observations, and indicative market value. Reports are provided for informational purposes and do not constitute a gemological certificate, professional appraisal, or guarantee of authenticity or value.

Personal information you disclose to us

In Short: We collect personal information that you provide to us.

We collect personal information that you voluntarily provide to us when you register on the Services,  express an interest in obtaining information about us or our products and Services, when you participate in activities on the Services, or otherwise when you contact us.

Sensitive Information. When necessary, with your consent or as otherwise permitted by applicable law, we process the following categories of sensitive information:
  • account login information and authentication credentials, including an email address together with a password or google authentication credential.
Payment Data. We may collect data necessary to process your payment if you choose to make purchases, such as your payment instrument number, and the security code associated with your payment instrument. Payments, subscriptions, billing, applicable taxes, refunds, and payment-related fraud prevention are processed through Lemon Squeezy, our Merchant of Record. Payment information is submitted directly to Lemon Squeezy or the payment method selected by the user. CaratScanner does not directly collect or store complete payment card numbers or card security codes. We receive limited transaction and subscription information, such as transaction identifiers, purchased products, payment status, subscription status, and customer contact information, as necessary to provide report credits, manage subscriptions, provide support, prevent fraud, process refunds, and comply with legal obligations. The payment provider’s own privacy policy applies to its processing of payment and billing information.

Social Media Login Data. We may provide you with the option to register with us using your existing social media account details, like your Facebook, X, or other social media account. If you choose to register in this way, we will collect certain profile information about you from the social media provider, as described in the section called " HOW DO WE HANDLE YOUR SOCIAL LOGINS? " below.

All personal information that you provide to us must be true, complete, and accurate, and you must notify us of any changes to such personal information.

Information automatically collected

In Short: Some information — such as your Internet Protocol (IP) address and/or browser and device characteristics — is collected automatically when you visit our Services.

We automatically collect certain information when you visit, use, or navigate the Services. This information does not reveal your specific identity (like your name or contact information) but may include device and usage information, such as your IP address, browser and device characteristics, operating system, language preferences, referring URLs, device name, country, location, information about how and when you use our Services, and other technical information. This information is primarily needed to maintain the security and operation of our Services, and for our internal analytics and reporting purposes.

The information we collect includes:
  • Log and Usage Data. Log and usage data is service-related, diagnostic, usage, and performance information our servers automatically collect when you access or use our Services and which we record in log files. Depending on how you interact with us, this log data may include your IP address, device information, browser type, and settings and information about your activity in the Services (such as the date/time stamps associated with your usage, pages and files viewed, searches, and other actions you take such as which features you use), device event information (such as system activity, error reports (sometimes called "crash dumps"), and hardware settings).
  • Device Data. We collect device data such as information about your computer, phone, tablet, or other device you use to access the Services. Depending on the device used, this device data may include information such as your IP address (or proxy server), device and application identification numbers, location, browser type, hardware model, Internet service provider and/or mobile carrier, operating system, and system configuration information.
  • Location Data. We collect location data such as information about your device's location, which can be either precise or imprecise. How much information we collect depends on the type and settings of the device you use to access the Services. For example, we may use GPS and other technologies to collect geolocation data that tells us your current location (based on your IP address). You can opt out of allowing us to collect this information either by refusing access to the information or by disabling your Location setting on your device. However, if you choose to opt out, you may not be able to use certain aspects of the Services.
  • Cookie and online identifiers . Cookie identifiers, analytics identifiers, advertising identifiers, account or user identifiers, and session identifiers used for authentication, security, analytics, attribution, and service operation.
  • Website interaction and event data . Information about page views, button clicks, quiz progress and selected answers, image scan or upload interactions, report activity, checkout interactions, and conversion events.
  • Referral and campaign attribution data . Referring URLs, traffic source and medium, UTM parameters, advertising campaign identifiers, and related attribution information.
  • Session replay and diagnostic data . Scrolls, taps, mouse movements, navigation behavior, viewport information, session recordings, heatmaps, performance information, and technical errors used to understand and improve the service.

Information collected from other sources

In Short: We may collect limited data from public databases, marketing partners, social media platforms, and other outside sources.

In order to enhance our ability to provide relevant marketing, offers, and services to you and update our records, we may obtain information about you from other sources, such as public databases, joint marketing partners, affiliate programs, data providers, social media platforms,  and from other third parties. This information includes mailing addresses, job titles, email addresses, phone numbers, intent data (or user behavior data), Internet Protocol (IP) addresses, social media profiles, social media URLs, and custom profiles, for purposes of targeted advertising and event promotion.

If you interact with us on a social media platform using your social media account (e.g., Facebook or X), we receive personal information about you from such platforms such as your name, email address, and gender. You may have the right to withdraw your consent to processing your personal information. Learn more about withdrawing your consent. Any personal information that we collect from your social media account depends on your social media account's privacy settings. Please note that their own use of your information is not governed by this Privacy Notice.

2. HOW DO WE PROCESS YOUR INFORMATION?

In Short: We process your information to provide, improve, and administer our Services, communicate with you, for security and fraud prevention, and to comply with law. We process the personal information for the following purposes listed below. We may also process your information for other purposes only with your prior explicit consent.

We process your personal information for a variety of reasons, depending on how you interact with our Services, including:
  • To facilitate account creation and authentication and otherwise manage user accounts. We may process your information so you can create and log in to your account, as well as keep your account in working order. (Retention period: For as long as the account remains active. Account credentials and profile identifiers are deleted or anonymized within 30 days after account closure or a verified deletion request, except for limited records retained for up to 24 months for fraud prevention, dispute resolution, and account integrity, or longer where required by law.)
  • To deliver and facilitate delivery of services to the user. We may process your information to provide you with the requested service. (Retention period: For as long as the account remains active and the reports remain available to the user. Account-associated images are deleted within 30 days after account deletion. Abandoned or failed uploads are retained for up to 30 days, and guest reports and associated images for up to 12 months.)
  • To respond to user inquiries/offer support to users. We may process your information to respond to your inquiries and solve any potential issues you might have with the requested service. (Retention period: For up to 24 months after the inquiry is resolved. Communications connected to an active dispute, refund, chargeback, or legal claim may be retained for up to 10 years after final resolution where reasonably necessary or legally required.)
  • To send administrative information to you. We may process your information to send you details about our products and services, changes to our terms and policies, and other similar information. (Retention period: For up to 24 months after the communication is sent. Administrative communications relating to purchases, subscriptions, refunds, disputes, or legally required notices may be retained with the related transaction records for up to 10 years.)
  • To fulfill and manage your orders. We may process your information to fulfill and manage your orders, payments, returns, and exchanges made through the Services. (Retention period: For up to 10 years after the relevant transaction or subscription ends, to the extent necessary for accounting, tax, payment reconciliation, refunds, chargebacks, fraud prevention, dispute resolution, and compliance with legal obligations.)

  • To request feedback. We may process your information when necessary to request feedback and to contact you about your use of our Services. (Retention period: For up to 24 months after the feedback is submitted or the request is sent. Feedback that has been irreversibly anonymized may be retained for service improvement without a fixed retention period.)
  • To protect our Services. We may process your information as part of our efforts to keep our Services safe and secure, including fraud monitoring and prevention. (Retention period: Security and operational records are generally retained for up to 12 months. Records associated with confirmed fraud, security incidents, chargebacks, abuse, or legal claims may be retained for up to 3 years after the matter is closed, or longer where required by law.)
  • To identify usage trends. We may process information about how you use our Services to better understand how they are being used so we can improve them. (Retention period: For up to 14 months from collection, after which the information is deleted or aggregated or anonymized so that it no longer identifies the user.)
  • To save or protect an individual's vital interest. We may process your information when necessary to save or protect an individual’s vital interest, such as to prevent harm.
  • Account creation and authentication . To register users, verify email addresses, enable email or Google sign-in, maintain authenticated sessions, recover accounts, and manage account access. (Retention period: For the life of the account. Authentication credentials are disabled or removed upon account deletion, subject to limited security and legal retention.)
  • Processing gemstone analysis requests . To process uploaded images, quiz responses, and related request information in order to perform the requested analysis and generate a report. (Retention period: For as long as necessary to provide report access and thereafter as required for dispute resolution, fraud prevention, security, and legal compliance.)
  • Subscription and report credit administration. To verify service entitlement, allocate or deduct report credits, and administer trial access, subscriptions, renewals, cancellations, refunds, and purchased credit packages. (Retention period: For the duration of the customer relationship and thereafter as required for accounting, payment disputes, chargebacks, fraud prevention, and legal compliance.)
  • Report access and account history . To associate reports with the correct account, display report history, and allow authorized users to access previously purchased reports. (Retention period: For the life of the account and thereafter only as reasonably necessary for transaction records, dispute resolution, security, and legal compliance.)
  • Service reliability and troubleshooting. We process limited device, log, error, and performance information to diagnose failures, monitor system health, and maintain the availability of the service. (Retention period: For as long as reasonably necessary to investigate technical issues, security incidents, and service performance.)
  • Fraud and abuse prevention . We process account, authentication, device, transaction, subscription, and usage information to identify unauthorized access, fraudulent activity, duplicate fulfillment, credit manipulation, and misuse of the service. (Retention period: For the customer relationship and thereafter as reasonably necessary for fraud investigations, security incidents, payment disputes, and legal compliance.)
  • Payment and credit record integrity . We process order, webhook, subscription, refund, and credit records to reconcile transactions, avoid duplicate credit allocation, and investigate payment or fulfillment discrepancies. (Retention period: For the customer relationship and applicable accounting, chargeback, dispute, and legal retention periods.)
  • Establishing and defending legal claims. We may retain and review relevant account, transaction, report, communication, and security records when necessary to investigate complaints or establish, exercise, or defend legal claims. (Retention period: Until the relevant dispute is resolved and applicable legal limitation periods have expired.)

3. WHAT LEGAL BASES DO WE RELY ON TO PROCESS YOUR INFORMATION?

  • Legal Obligations. We may process your information where we believe it is necessary for compliance with our legal obligations, such as to cooperate with a law enforcement body or regulatory agency, exercise or defend our legal rights, or disclose your information as evidence in litigation in which we are involved.
  • Vital Interests. We may process your information where we believe it is necessary to protect your vital interests or the vital interests of a third party, such as situations involving potential threats to the safety of any person.

We may share your information with Google Analytics to track and analyze the use of the Services. The Google Analytics Advertising Features that we may use include: Remarketing with Google Analytics and Google Analytics Demographics and Interests Reporting . In Short: We offer products, features, or tools powered by artificial intelligence, machine learning, or similar technologies.

As part of our Services, we offer products, features, or tools powered by artificial intelligence, machine learning, or similar technologies (collectively, "AI Products"). These tools are designed to enhance your experience and provide you with innovative solutions. The terms in this Privacy Notice govern your use of the AI Products within our Services.

Use of AI Technologies

We provide the AI Products through third-party service providers ("AI Service Providers"), including Google Cloud AI and Google Gemini . As outlined in this Privacy Notice, your input, output, and personal information will be shared with and processed by these AI Service Providers to enable your use of our AI Products for purposes outlined in " WHAT LEGAL BASES DO WE RELY ON TO PROCESS YOUR PERSONAL INFORMATION? " You must not use the AI Products in any way that violates the terms or policies of any AI Service Provider.

How We Process Your Data Using AI

All personal information processed using our AI Products is handled in line with our Privacy Notice and our agreement with third parties. This ensures high security and safeguards your personal information throughout the process, giving you peace of mind about your data's safety.

How to Opt Out

We believe in giving you the power to decide how your data is used. To opt out, you can:
  • Contact us using the contact information provided
  • Do not upload or submit an image for analysis. AI-assisted processing is required to generate a CaratScanner report, and an AI-free report option is not currently available.

7. HOW DO WE HANDLE YOUR SOCIAL LOGINS?

In Short: If you choose to register or log in to our Services using a social media account, we may have access to certain information about you.

Our Services offer you the ability to register and log in using your third-party social media account details (like your Facebook or X logins). Where you choose to do this, we will receive certain profile information about you from your social media provider. The profile information we receive may vary depending on the social media provider concerned, but will often include your name, email address, friends list, and profile picture, as well as other information you choose to make public on such a social media platform.

We will use the information we receive only for the purposes that are described in this Privacy Notice or that are otherwise made clear to you on the relevant Services. Please note that we do not control, and are not responsible for, other uses of your personal information by your third-party social media provider. We recommend that you review their privacy notice to understand how they collect, use, and share your personal information, and how you can set your privacy preferences on their sites and apps.

8. IS YOUR INFORMATION TRANSFERRED INTERNATIONALLY?

In Short: We may transfer, store, and process your information in countries other than your own.

Our servers are located in Germany , United States , Turkey , France and Ireland . Regardless of your location, please be aware that your information may be transferred to, stored by, and processed by us in our facilities and in the facilities of the third parties with whom we may share your personal information (see " WHEN AND WITH WHOM DO WE SHARE YOUR PERSONAL INFORMATION? " above), including facilities in the United States, Germany, Ireland, France,  and other countries.

If you are a resident in the European Economic Area (EEA), United Kingdom (UK), or Switzerland, then these countries may not necessarily have data protection laws or other similar laws as comprehensive as those in your country. However, we will take all necessary measures to protect your personal information in accordance with this Privacy Notice and applicable law.

European Commission's Standard Contractual Clauses:

We have implemented measures to protect your personal information, including by using the European Commission's Standard Contractual Clauses for transfers of personal information between our group companies and between us and our third-party providers. These clauses require all recipients to protect all personal information that they process originating from the EEA or UK in accordance with European data protection laws and regulations.  Our Standard Contractual Clauses can be provided upon request.  We have implemented similar appropriate safeguards with our third-party service providers and partners and further details can be provided upon request.

9. HOW LONG DO WE KEEP YOUR INFORMATION?

In Short: We keep your information for as long as necessary to fulfill the purposes outlined in this Privacy Notice unless otherwise required by law.

We will only keep your personal information for as long as it is necessary for the purposes set out in this Privacy Notice, unless a longer retention period is required or permitted by law (such as tax, accounting, or other legal requirements). If you are located in the EU or UK, see section "HOW DO WE PROCESS YOUR INFORMATION? " for our retention periods by purpose.

When we have no ongoing legitimate business need to process your personal information, we will either delete or anonymize such information, or, if this is not possible (for example, because your personal information has been stored in backup archives), then we will securely store your personal information and isolate it from any further processing until deletion is possible.

12. CONTROLS FOR DO-NOT-TRACK FEATURES
